Tenn. Two Waverly men were found innocent here yesterday of first degree murder in the I960 nhot-gun death of a Waverly businessman. The all-male circuit court Jury required only 20 minutes deliberation to return a verdict of icquittal in tha trial of Tom Ferguson 30, and David warren. 31, who had been ac cused in the death of William Edward Gunn, 31. The dead man's slstpr.

Mr. Ora Lee McCarey of Waverly, collapsed when the verdict wus given and had to be carried from the courtroom. "I SWEAR I regret that," said warren, referring to Mrs. Me Carey's collapse, "but I believe the verdict was a fair one." yesterday's trial, the second on the murder charge, began at 8 a.m. The verdict was returned about 5:45 p.m.

Gunn was fatally wounded by a shotgun blast at his hunting lodge on Kentucky Lake in January, 1960. The defendants, in September, 1961, were tried on a robbery charge in connection with the incident Both served a sentence of 11 months and 29 days in county Jail on conviction of attempting to commit a felony in what the state contended was am effort to rob a poker game at the lodge. A MISTRIAL was ruled a year ago in the first trial on the murder charge when the jury failed to agree on a verdict. Defense Attorney Robert Polk of Nashville read a statement yesterday from a former Wav. erly physician.

Dr. F. G. Mc-Campbell, which said Warren re ceived a head cut during the fight at the lodge that required 18 stitches. In summing up his case for the defendants.

Polk speculated that Gunn had grabbed the shot gun from Warren, knocked him to the floor and was beating the man over the head with the gun when it discharged. The de fense Introduced no witnesses yesterday. The defendants had previously stated they were only "pranking" and had no intention of robbing the poker game which they themselves had uarticipated in only hours before. Mrs. Lola Wallace Mrs.

Lola Bass Wallace of 227 Sunrise died of cancer yesterday at a Nashville hospital. Funeral arrangements were incomplete last night. A native of Waverly, she was a daughter of the late William David and Llllie Mc Donough Bass. She was edu rated in Waverly, and had been a resident of Nashville for seven! years. She was an employe of Davidson County Hospital.

Morris Funeral Today Services for Louis B. Morris, 76, of 2106 Ashwood Court, retired owner of Morris Cafeteria and the Savoy Cafe, will be at 2 p.m. today at the Greek Ortho dox Church. The Rev. John Sfikas will of ficiate.

Burial will be in Wood-lawn Memorial Park. Morris died of a stroke yes terday morning at St. Thomas Hospital. A native of Argos, Greece, he came to the United States in lftOl and had lived in Nashville 56 years. Morris married Miss Margaret Cokinos of Spara.

TYLER. Tex. prison-bound associate of former West Texas financier Billie Sul Estes testified yesterday about mort- gago manipulations he said aggregated $18 million. Harold E. Orr, 31, of Amarlllo.

testified that he forged one instrument. His statement about tha 18 million total was stricken from the record. The jury was told to consider only a statement that the first transaction, which Orr said was arranged by Estes, totaled $250,000. Estes, now bankrupt, is on trial here on state charces of theft and swindling, ORR IS ONE of three men formerly associated with Estes who admitted guilt and accepted prison terms on indictments charging mail fraud and conspiracy returned by a 'federal grand jury at El Paso, Tex. The other two are Coleman Mc-Spadden, 45, of Lubbock.

Tex. and Ruel W. Alexander, 36, of Amarnio, The three were officials and principal owners of the Superior Manufacturing a fertilizer tank firm which Estes is ao cused of using for multi-million-dollar manipulations in bogus mortgages. Orr and McSpadden are under 10-year sentences and Alexander a 6-year sentence. Estes pleaded innocent and is awaiting trial on the federal indictments.

Chief defense counsel John Cofer had predicted, arguments tiy attorneys, that Orr would admit forging one of the mort gages and would say "Bill Sol told me to." Orr did just that. Orr said the original of the forged mortgage, in the amount of $94,500, was signed hy Pecos, farmer T. J. Wilson in Estes' offices in Pecos March 2. 1961.

He said he later discovered that a stenographer had typed the word "tanks'' when It should have been "trailer." Orr said he instructed one of his secretaries to erase and substitute the correct word "and she fouled it up real good. I had to retype it." James T. Rains James T. Rains, 92, of 1112 Halcyon a retired farmer and dairyman, died of a kidney ailment yesterday at his home. Services will be at 11 a.m.

He had been a resident of Davidson County all his life. His first wife was the former Molly Owen. After her death, he married Miss Dellar Jane Willis in 1937. She survives. Rains was a member of Cen tral Church of Christ.

Other survivors are a daugh ter. Miss Maude Rains, Nashville; a son, Crockett Rains, Nashville; a sister, Mrs. Lucy Henslev.
