The police chief admits he may have to cite one of the joggers again if complaints continue.

He flatly rejected Kelly's argument that the law did not apply to him because he was running rather than walking in the road. The judge did make three observations: Joggers running several abreast are obstructing the roadway. The emergency communication system should not be used to report the joggers. The city might want to designate Fair-acres as a jogging trail. Kelly said he was pleased with the dismissal.

He said the joggers want to see dangerous to run on the sidewalks that are in poor condition. Jogger Mike Kelly admits his fellow runners occasionally jog several abreast But he says they move aside for oncoming cars. The dispute has been going on for years with repeated calls to 911 to report the joggers. Police cited Kelly last month hoping to settle the issue once and for all. Judge Robert Boatwright dismissed the citation yesterday.

He said the city did not provide sufficient evidence about the condition of the sidewalks. Loring has been the most vocal about a particular group of joggers who run several abreast in his neighborhood. Loring says the men wont use the sidewalks or move out of the way for cars. "We have an arrogant bunch of men who refuse to comply with the law or common sense," Loring said. State law and a city ordinance prohibit pedestrians from using the street when a sidewalk is available.

He was a member of Belmont Church and a foundei of St Paul Southern Methodist Church. He was also a past board member at the Commo dore Club.
