(AP) The Tennessee Trial Lawyers Association wants the legislature to remove the cap on damages local governments can be made to pay for negligence in personal injury lawsuits. John Summers, executive director of the group, said the transformer explosion in front of the NASCAR Cafe in downtown Nashville last year that killed one person and injured three others showed the hardship the limits can create. "Why shouldn't a government be asked to pay for damages when they do harm?" Summers said during a stop in Johnson City.

Still, TennCare officials said they are confident approval of the State Children's Health Insurance Program, SCHIP, will come. "Kids in Tennessee have not suffered because we don't have approval," Lindsey said. Because Tennessee was ahead of the game in 1994 in reforming its Medicaid system and expanding it to cover uninsured Tennesseans, its children's plan is different from approved plans in other states.
