THE TENNESSEAN Friday, April 1995 5B Attorney dies of cancer at 54 Funeral services for former Nashville attorney John B. Axton will be held tomorrow in Ada, where he's lived since the early 1980s. Axton was the son of Heartbreak Hotel co-writer Mae Axton and the brother of singer Hoyt Axton, who wrote Joy to the World. John Axton, 54, died of cancer Wednesday at his home. He practiced law in Oklahoma and for a while in Nashville.

He is survived by his wife, Martha; his children, Shaun and Heather; and his mother and brother. The family requests donations be sent to the Francis Preston Martel Foundation, Drawer T2464, Nashville, 37244. Police believe a 35-year-old man shot and killed his father in his sleep just to get $700 and a few guns. Jackie H. Johnson, 35 whom police describe as a transvestite also known as Denise was arrested Wednesday after police found him hiding out in a friend's Nashville apartment off Rio Vista Drive.

"I think it'll be a death penalty case," said Capt. Jacob G. Phillips with the Overton County Sheriff's Department. Police said Herman Johnson, 65, died instantly last Oct. 16 after 1 he was shot in the side of the head at close range with a small-caliber gun as he slept in his bedroom.

After the recent death of his wife, the victim had lived at his Oakhill Road home off U.S. 42 South with his only son. He also has a daughter who did not live at the home. Jackie Johnson, who police said has a prior murder conviction, was already being sought by Rutherford County police after he failed to appear in court on charges of aggravated assault with a knife, illegal possession of a weapon and public intoxication. "We spent a lot of time looking for him," said Sgt. Chuck Thomas with the Rutherford County Sheriff's Department. The search was complicated by the fact that he sometimes dressed as a woman. A devoted educator, her teaching career spanned over fifty five years in Trousdale and Smith Counties. She was a member of the Peyton Creek Baptist Church. In addition to her parents, she was preceded in death by five sisters, Deltha Wilmore, Ola Gregory, Annie Petty, Stone and her twin, Ellie Hackett; brother, Herlin Nixon.
